Merchant Agreement

Nothing in this policy is intended to exclude or restrict any mandatory right or remedy available to you under applicable Mauritius law.
1. Role of the parties
This Merchant Agreement is between the Merchant and MOENA.ONLINE. The Merchant sells its Products to Customers. MoEna provides marketplace, payments-facilitation, optional logistics and related services. MoEna is not automatically the seller of the Merchant’s Products.
2. Onboarding and KYC
The Merchant must complete application and KYC, keep BRN and identity details accurate, and not operate until the store is activated. Verification is separate from marketing consent.
3. Listings and Orders
The Merchant is responsible for listing accuracy, lawful Products, stock, packing, invoicing and after-sales. Accepted Orders must be fulfilled with reasonable care.
4. Fees and VAT
Commission and service fees are as configured on the Platform. Where the Merchant is VAT-registered and makes a taxable supply, the Merchant accounts for VAT on that supply. MoEna accounts for VAT on MoEna’s own taxable supplies. Not every Merchant is VAT-registered.
5. Customer data
Customer data obtained through MoEna may be used only to fulfil the Order and related support, in line with the Privacy Policy and applicable law.
